Privacy Policy

This Privacy Policy explains how HummingAgent ("HummingAgent," "we," "us," or "our") collects, uses, discloses, and protects personal information in connection with the HumCrew website at humcrew.com (the "Site") and the HumCrew communications and service-operations platform (the "Service"). HumCrew is a HummingAgent company.

Information we collect on the Site
When you visit the Site, we may collect:
- Contact information you provide, such as your name, email address, company name, and phone number, when you book a call or email us.
- Usage data, such as pages viewed, referring pages, approximate location derived from IP address, browser type, and device information, collected through standard server logs and any analytics tools we use.
- Scheduling information you submit through third-party booking tools (for example, Calendly) when you book a consultation. Those tools handle your data under their own privacy policies.
Information we collect through the Service
The Service handles configured calls, messages, customer records, and scheduling activity on behalf of our business clients, such as home services companies. When you communicate with a business through the Service, we may collect:
- Call audio. Calls may be recorded so that our clients receive an accurate record of the conversation.
- Call transcriptions and summaries generated from the call audio.
- Information you provide during a call, message, chat, or booking request, such as your name, company, callback number, service address, job details, and the reason for your contact.
- Communication metadata, such as the originating and destination numbers, channel, delivery status, and the date, time, and duration of the interaction.
- Customer, consent, service-request, appointment, and related operational records created or updated through the Service.
AI and recording disclosure
Calls answered by the Service are handled by an artificial intelligence assistant, and callers are informed at the beginning of the call that they are speaking with an AI assistant. Where call recording is enabled, callers are notified that the call may be recorded or transcribed. If you do not wish to be recorded, you may end the call and contact the business through another channel.
Text messaging (SMS)
Text messaging is available only where a business client's exact sending line has completed the required carrier registration, provider configuration, and HumCrew routing checks. Where enabled, the Service sends and receives SMS messages with that client's customers.
If a recent inbound call ends before the caller's request is resolved, the Service may send one service-related missed-call rescue text about that call, unless the person previously opted out, and only where applicable law and messaging-provider rules permit. Messaging-hour and frequency safeguards apply. That single reply does not enroll the person in ongoing text messaging. Any further proactive request or appointment texts require the appropriate recorded consent.
Request and appointment texts may include scheduling conversation, confirmations, reminders, reschedules, cancellations, and service-related transactional follow-up limited to delivery, status, scheduling, or next steps for a quote or estimate the customer requested. Promotional messages, including sales content that solicits a new purchase and outreach to dormant customers based on past jobs or seasonal services, require separate valid marketing consent. Permission for service-related messages is not treated as permission for promotional messages.
Ongoing service-message consent may be captured when a customer selects an unchecked consent box in a booking flow, completes any required number verification for a chat request, explicitly agrees during a call or active conversation, or gives another recorded opt-in appropriate to the message type. A person's own inbound SMS permits replies about that conversation, but it is not treated as permission for promotional messages. Consent and its purpose are recorded for each person and channel.
Message frequency varies with your appointment and request activity. Message and data rates may apply. Reply STOP to any message to stop receiving texts, and reply HELP for help. We honor a STOP request immediately, and after a STOP we will not text that number again unless the person sends START or completes another valid, recorded re-consent supported by the messaging provider.
Mobile information, including phone numbers collected for text messaging and the consent to receive text messages, is not shared with or sold to third parties or affiliates for marketing or promotional purposes. We share mobile information with the business client the message relates to and with the messaging providers that carry the message on our behalf, and those providers may not use it for their own marketing. Other disclosures are limited to the circumstances described in How we share information below, such as a legal requirement or a business transaction. We do not sell or rent mobile information.
How we use information
We use the information described above to:
- Provide, operate, maintain, and improve the Site and the Service.
- Deliver communication summaries, logs, transcriptions, messages, and captured details to the business client on whose behalf the Service handled the interaction.
- Respond to inquiries and schedule and conduct consultations.
- Monitor quality, troubleshoot issues, and improve the accuracy and safety of the Service.
- Comply with legal obligations and enforce our agreements.
We do not sell personal information, and we do not use the content of client communications for advertising.
How we share information
We share personal information only as follows:
- With the business client on whose behalf the Service handled your communication. That client uses the information to run its operations, and its own privacy practices apply to its use.
- With service providers that support our infrastructure, such as cloud hosting, telephony, transcription, and analytics providers, under contracts that restrict their use of the data.
- When required by law, legal process, or a governmental request, or to protect the rights, safety, or property of HummingAgent, our clients, or others.
- In connection with a merger, acquisition, financing, or sale of assets, in which case we will require the recipient to honor this policy.
- Never for third-party marketing: mobile phone numbers and text-messaging consent are not shared with or sold to third parties or affiliates for their own marketing or promotional use.
Data retention
We retain Site inquiry data for as long as needed to respond to you and maintain our business records. Communications, recordings, transcriptions, messages, summaries, and related service records are retained according to the retention schedule agreed with the relevant business client and are deleted or anonymized when no longer needed, unless a longer period is required by law.
Security
We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and monitoring. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Your rights and choices
Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, to object to or restrict certain processing, and to withdraw consent where processing is based on consent. To exercise these rights, email hello@hummingagent.ai. If your request concerns a communication or service record handled on behalf of one of our clients, we may refer your request to that client or work with them to fulfill it. You may also have the right to lodge a complaint with your local data protection authority.
Children
The Site and the Service are intended for business use and are not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will delete it.
International transfers
We are based in the United States and may process information on servers located there and in other countries. Where required, we use appropriate safeguards for cross-border transfers of personal information.
Changes to this policy
We may update this Privacy Policy from time to time. We will post the updated version on this page and revise the effective date above. Material changes will be communicated through the Site or by other reasonable means.
